McKenzie Friends

What Is a McKenzie Friend?

If you're representing yourself in family court, you have the right to bring someone with you to support you. This person is called a McKenzie Friend.


A McKenzie Friend is not a lawyer, but they can help you feel more confident and prepared during your hearing.

What a McKenzie Friend Can Do

  • Sit with you in court
  • Take notes
  • Help you organise your documents
  • Quietly give you advice and support
  • Suggest questions you might want to ask
  • Help you stay calm and focused


They are there to support you, not to speak for you.

What a McKenzie Friend Cannot Do (Unless the Judge Allows)

  • Speak on your behalf (this is called “addressing the court”)
  • Question witnesses
  • Sign documents for you
  • Act as your legal representative


Only a judge can give permission for a McKenzie Friend to speak in court, and this is rare.

Who Can Be a McKenzie Friend?

  A McKenzie Friend can be:


  • A friend or family member
  • A volunteer from a support organisation
  • Someone with legal knowledge (but not necessarily a qualified lawyer)


They must not:


  • Have a conflict of interest in your case
  • Be disruptive or disrespectful in court
  • Charge you unreasonable fees (if they are offering paid support)


They must:


  • Understand and agree to keep the court papers and court hearing confidential

Letting the Court Know

  • Tell the court in staff if you plan to bring a McKenzie Friend
  • Be ready to explain who they are and how they will help you
  • The court staff may ask the McKenzie Friend to complete a form 
  • Ask the judge for permission at the start of the hearing for the McKenzie Friend to be present in the hearing
